These Terms and Conditions ("Terms") are a binding agreement between you and Sanghance ("Sanghance", "we", "us", or "our") governing your access to and use of ClubOn, including its mobile apps, private web app, public website, content, communications, and related services (together, the "Service").
Please read these Terms and our Privacy Policy carefully. By creating an account, accepting the in-app safety notice, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use ClubOn.
1. About ClubOn
ClubOn helps adults record drinks, view estimate-based awareness context, plan nightlife, find spots, and optionally interact with other users. ClubOn is a planning and awareness tool only. It is not a medical device, breathalyser, emergency service, transport provider, venue operator, alcohol seller, or source of medical, legal, or professional advice.
2. Eligibility
You may use ClubOn only if:
- You are at least 18 years old and at least the legal drinking age in the place where you use the Service, whichever is higher
- You are legally capable of entering into this agreement
- You are not prohibited from using the Service under applicable law
- We have not previously suspended or terminated you for serious or repeated violations, unless we expressly permit your return
You must provide accurate age and account information. ClubOn does not authorise an underage person to buy, possess, or consume alcohol. Venues and sellers must perform their own legally required age checks.
3. Accounts and sign-in
You may sign in using supported methods such as email, Google Sign-In, or Sign in with Apple. You are responsible for:
- Keeping your device, email account, sign-in provider, password, and credentials secure
- Activity performed through your account, except to the extent caused by our failure to use reasonable care
- Keeping your account information accurate and current
- Promptly notifying us if you suspect unauthorised access
Do not share credentials, create accounts using another person's identity without authority, buy or sell accounts, or use automated means to create accounts. We may require reauthentication or reasonable verification before a sensitive account action.
4. Safety and alcohol disclaimer
ClubOn does not encourage alcohol consumption. If you choose to drink, you are solely responsible for complying with law and making safe decisions.
You acknowledge that:
- ClubOn's impact, pace, recovery, or blood-alcohol-context outputs are estimates based on limited user inputs and general assumptions
- Estimates may be delayed, incomplete, inaccurate, unavailable, or unsuitable for your body, health, medication, drink, serving size, or circumstances
- Feeling normal or receiving a low estimate does not mean you are unimpaired, below a legal limit, or safe to drive
- ClubOn cannot detect every drink, substance, illness, medication interaction, delayed absorption, or individual risk
- No ClubOn message, colour, ring, reminder, or estimate grants permission to continue drinking or perform a safety-sensitive activity
Never use ClubOn to decide whether to drive, ride, swim, operate machinery, supervise a vulnerable person, take medication, or consume more alcohol. Use a designated driver or trusted transport option. If someone is unconscious, difficult to wake, breathing abnormally, vomiting repeatedly, confused, having a seizure, or may otherwise be in danger, contact local emergency services immediately.
5. Location, maps, venues, and transport
Location and place features may use device location, user input, Google Maps Platform, Google Places, venue information, and community activity. You choose whether to grant location permission and whether to publish a presence, buddy request, or message.
Map, venue, rating, opening-hour, distance, crowd, contact, availability, and transport information may be inaccurate, incomplete, delayed, or supplied by third parties. Verify important information directly. ClubOn does not endorse, control, or guarantee any venue, event, route, transport provider, user, or third-party listing.
By using Google Maps features, you agree to the Google Maps or Google Earth Additional Terms and acknowledge the Google Privacy Policy.
6. Social features and visibility
ClubOn may offer venue presence, place chat, nearby chat, buddy requests, connections, group chat, direct messages, profile interactions, and read-only support messages.
Before using a social feature, understand its visibility:
- Going-tonight, checked-in, venue, buddy-request, place-chat, and nearby-chat activity may be visible to eligible users in that context
- Direct messages are visible to the participants and may be accessed by authorised personnel when reasonably necessary for support, safety, moderation, enforcement, or legal compliance
- Drink logs, private night sessions, estimate settings, body settings, and vibe checks are intended to remain private to your account
- Another user may screenshot, copy, or redistribute content they can see
Do not share an exact location, home address, workplace schedule, financial information, identification document, intimate content, or other sensitive information unless you understand the risk. Meeting another user is your choice and risk. Meet in a public place, tell someone you trust, arrange independent transport, and leave if you feel unsafe.
7. Your content
"User Content" means text, images, profile information, messages, requests, reports, feedback, or other material you submit through the Service.
You retain ownership of your User Content. You give us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, adapt for technical formatting, transmit, display, and otherwise process User Content only as reasonably necessary to operate, secure, improve, moderate, promote, and provide the Service, comply with law, and enforce these Terms. This licence lasts for as long as the content remains on the Service and for a reasonable period in backups, safety records, or legal records. Feedback and suggestions may be used without restriction or payment, provided we do not publicly identify you without permission.
You represent that you have the rights and permissions needed to submit User Content and that our permitted use will not violate another person's rights or law.
8. Acceptable use
You must use ClubOn lawfully, honestly, and respectfully. You must not create, upload, transmit, promote, or facilitate content or conduct that:
- Belongs to another person and you have no right to share
- Is unlawful, fraudulent, defamatory, obscene, pornographic, invasive of privacy, or harmful to a child
- Harasses, threatens, stalks, bullies, intimidates, exploits, or discriminates against a person or group
- Encourages dangerous drinking, drink tampering, impaired driving, violence, self-harm, or other serious harm
- Impersonates another person, misrepresents affiliation, uses a deceptive identity, or manipulates another user
- Shares another person's personal, intimate, financial, confidential, or location information without lawful authority
- Infringes intellectual property, publicity, privacy, contractual, or other rights
- Promotes illegal goods, controlled substances, underage drinking, trafficking, sexual exploitation, or criminal activity
- Contains malware, malicious code, spam, scams, phishing, unauthorised advertising, or deceptive links
- Is knowingly false or misleading in a way likely to cause harm
- Attempts to bypass a block, restriction, moderation action, age gate, rate limit, access control, or security measure
- Scrapes, harvests, crawls, indexes, reverse engineers, probes, attacks, overloads, disrupts, or gains unauthorised access to the Service or another account
- Uses bots, scripts, automation, or data extraction except where we have given written permission
- Uses ClubOn to build, train, benchmark, or improve a competing database, model, service, or product without written permission
- Violates applicable law, these Terms, a published community rule, or a reasonable safety instruction
Do not falsely report another user or misuse support, complaint, or emergency channels.
9. Reports, moderation, and enforcement
You can report content or conduct through available in-app tools or by contacting us. We may review reports, relevant content, account records, and technical evidence; use automated or human review; remove or restrict content; limit features; issue warnings; block interactions; preserve evidence; or suspend or terminate accounts.
We may act where we reasonably believe these Terms, law, or safety expectations have been violated, but we do not promise to monitor every interaction or resolve every dispute. Moderation decisions may consider severity, context, evidence, repetition, risk, and legal requirements. We may not be able to disclose all evidence or enforcement details because of privacy, safety, legal, or security concerns.
If you believe a decision is wrong, contact the grievance address in Section 25 with relevant details. Nothing in these Terms limits a right to seek review from a competent authority where applicable.
10. Advertising and promotions
ClubOn may display advertisements, sponsored placements, promotions, or links supplied by us or third parties. We do not guarantee an advertiser, offer, product, venue, or claim. Your dealings with an advertiser or third party are between you and that party.
Ads may be selected or measured using device, consent, approximate location, or interaction data as described in our Privacy Policy and the provider's policy. Available privacy choices depend on your region, platform, and device settings.
11. Notifications and communications
With your permission, ClubOn may send service, safety, reminder, social, support, or promotional notifications. Delivery is not guaranteed and may be delayed or suppressed by device, network, provider, or platform settings. Never rely on a ClubOn notification as an emergency alert or sole safety control.
You can manage supported notification preferences in ClubOn, your device settings, or the relevant provider controls. We may still send essential account, security, legal, or service messages where permitted.
12. Third-party services
The Service relies on or links to third-party services, including Firebase, Google, Apple, Google Maps Platform, OneSignal, Google Mobile Ads, app stores, venue websites, telephone and email apps, and transport or direction services. Third-party services are governed by their own terms, privacy policies, availability, and charges.
We are not responsible for third-party content, transactions, security, accuracy, availability, or conduct. A link or integration does not mean we endorse the third party. You are responsible for mobile data, internet, messaging, telephone, transport, venue, and other third-party charges.
13. Our intellectual property
The Service, excluding User Content and third-party material, including its software, design, branding, text, graphics, features, and compilation, is owned by or licensed to Sanghance and protected by applicable intellectual-property law.
Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable licence to install and use the Service for its intended, non-commercial purpose. No other right is granted. You may not copy, modify, distribute, sell, rent, sublicense, reverse engineer, decompile, or create derivative works from the Service except to the extent a restriction is prohibited by applicable law or an open-source licence expressly permits it.
Third-party names, maps, listings, logos, and content belong to their respective owners.
14. Copyright and rights complaints
If you believe content on ClubOn infringes your copyright, privacy, publicity, or another legal right, email the grievance contact in Section 25. Include:
- Your name and contact details
- A clear description of the work, right, or person affected
- The ClubOn content, account, message, or location involved
- Why you believe the content is unlawful or unauthorised
- A statement that your complaint is accurate and made in good faith
- Evidence that you own the right or are authorised to act for the owner
We may request more information, restrict access during review, forward relevant details to the person who posted the content where appropriate, and take action required by law. Knowingly false notices may have legal consequences.
15. Updates, availability, and changes to the Service
We may add, change, suspend, or discontinue features; impose reasonable usage limits; update compatibility; or require an app update. The Service may be interrupted by maintenance, network conditions, third-party failures, security events, legal requirements, or circumstances beyond our control.
We do not promise that every feature will remain available, work on every device, or be offered in every location. Where reasonably practicable, we will give notice of a material discontinuation that affects active users.
16. Paid features and app-store terms
ClubOn may offer paid features in the future. Before charging you, we will display the price, currency, billing period or one-time nature, included benefits, applicable taxes, renewal terms, and cancellation method required by law and the relevant platform.
Purchases through Apple App Store or Google Play are also governed by that store's terms and billing rules. Refunds, cancellations, and payment disputes may need to be handled through the store. Nothing in this section limits mandatory consumer rights.
17. Account deletion and termination by you
You may stop using ClubOn at any time. You can request account deletion through Settings > Account > Delete account, or use the instructions on our Delete Account page if you cannot access the app.
The in-app action currently submits a deletion request for processing; it does not promise instant removal of every record. Deletion is handled as described in our Privacy Policy and may require verification. Uninstalling the app, signing out, or disconnecting Google or Apple does not delete your ClubOn account.
18. Suspension and termination by us
We may restrict, suspend, or terminate access, remove content, or preserve relevant records if we reasonably believe that:
- You violated these Terms or applicable law
- Your account creates a safety, fraud, abuse, security, or legal risk
- A competent authority requires action
- Continued service is no longer technically, legally, or commercially practicable
Where appropriate and lawful, we may provide notice and an opportunity to appeal. We may act immediately in urgent, severe, or repeated cases. Termination does not affect accrued rights or provisions that by their nature should survive, including licences needed for retained content, intellectual property, disclaimers, liability limits, dispute terms, and legal compliance.
19. Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available". Sanghance does not warrant that the Service will be uninterrupted, error-free, secure, accurate, complete, suitable for a particular purpose, or free of harmful components; that estimates, venue details, user statements, moderation outcomes, notifications, or third-party services will be correct or timely; or that defects will always be corrected.
We do not make any warranty about another user, venue, advertiser, transport provider, map listing, or other third party. You remain responsible for your decisions, interactions, alcohol consumption, travel, health, and safety.
Nothing in these Terms excludes a warranty, guarantee, remedy, or right that cannot lawfully be excluded.
20. Limitation of liability
To the maximum extent permitted by law, Sanghance and its officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss; loss of profits, goodwill, opportunity, data, or business; or harm arising from another user, a venue, alcohol consumption, an inaccurate estimate, missed notification, location or map information, third-party service, unauthorised account access, or Service interruption.
Where liability cannot be excluded, our aggregate liability for claims arising out of the Service will not exceed the greater of the amount you paid directly to Sanghance for the Service during the 12 months before the event giving rise to the claim or INR 1,000, except where applicable law requires a different remedy or limit.
These limitations do not apply to liability that cannot lawfully be limited, including liability arising from fraud, wilful misconduct, or another category protected by applicable law. Your statutory consumer rights remain unaffected.
21. Indemnity
To the extent permitted by law, you agree to indemnify Sanghance against third-party claims, losses, and reasonable costs arising from your unlawful User Content, your material breach of these Terms, or your violation of another person's rights. This does not require you to indemnify us for our own negligence, wilful misconduct, or violation of law.
22. Governing law and disputes
These Terms are governed by the laws of India, without excluding mandatory rights you may have under the law of your place of residence.
Before filing a dispute, please contact us and give both sides a reasonable opportunity to resolve it informally. If it is not resolved, the courts and consumer forums with jurisdiction under applicable Indian law may hear the dispute. Nothing in these Terms prevents either party from seeking urgent protective relief or using a statutory grievance, regulatory, or consumer-redress mechanism.
23. Changes to these Terms
We may update these Terms to reflect changes in the Service, law, safety requirements, or business operations. We will publish the revised Terms with a new "Last updated" date and provide additional notice when required. If a material change requires consent, we will request it. Otherwise, continued use after the effective date of the revised Terms constitutes acceptance to the extent permitted by law.
24. General terms
- Entire agreement: These Terms, the Privacy Policy, and policies expressly incorporated by reference form the agreement about the Service.
- Severability: If a provision is unenforceable, it will be modified only as much as necessary and the remaining provisions will continue.
- No waiver: A delay in enforcing a provision is not a waiver.
- Assignment: You may not transfer your rights or obligations without our consent. We may transfer this agreement as part of a restructuring, financing, merger, acquisition, or sale, subject to applicable law.
- No agency: These Terms do not create an employment, partnership, joint venture, fiduciary, or agency relationship between you and Sanghance.
- Headings: Headings are for convenience and do not limit the Terms.

Do not send passwords, one-time passwords, payment-card details, or unnecessary identification documents. We will acknowledge and handle complaints within the periods required by applicable law.
